DECLARATION REQUIRED FROM THE APPLICANT
By submitting my new application, my application for continued entitlement or my notification of change to the Salzlandkreis Job Centre, I also make the following declarations:
I confirm that I have provided the information on the application and the associated attachments completely and correctly. I undertake to inform the authorising body immediately and without being asked of any changes that are relevant to the granting of the benefit - in particular family, income and financial circumstances as well as housing conditions. I am aware that this obligation applies to all members of the community of need. This also applies to the accuracy of the changes and additions made by me and the acceptance of the application.
I am aware that I and the members of my benefit community must reimburse any overpayment of benefits in the event of false or incomplete information or changes that are not reported immediately. Furthermore, I expose myself to the risk of administrative offence or criminal proceedings. I have been informed of my duty to co-operate and the consequences of failure to co-operate (§§ 60 ff., § 66 SGB I, § 31 SGB II and § 40 SGB II). I have also been informed that I must notify the benefit provider immediately and without being asked of any changes to my family, income and financial circumstances as well as temporary absences, hospitalisation, etc., including those of household members. Any work, including occasional work, must be reported to the benefit provider immediately - enclose a copy of proof.
It is assumed that the applicant has taken on the representation of the community of need. This presumption no longer applies if other members of the benefit community declare to the job centre that they wish to represent their interests themselves (Section 38 SGB II).
The data requested on the application form is collected, stored and processed on the basis of §§ 67 - 85a SGB X, § 35 SGB I and §§ 50 ff. SGB II for the lawful fulfilment of tasks in accordance with SGB II. I/we am/are aware that the personal data will be stored in an automated data processing system for the purpose of calculating benefits.
Information from third parties, e.g. on periods of employment, investment income, statutory pension and accident insurance benefits, employment promotion benefits, is obtained and utilised by means of automated data matching. I therefore ensure that the members of my benefit community are informed about the obligations to co-operate and receive all necessary information.
I have taken note of all the above-mentioned notes and information sheets.
SUPPLEMENTARY INFORMATION ON THE APPLICATION FOR BENEFITS UNDER SGB II
Education and participation package
When applying for basic income support for job seekers, from 1 August 2019 onwards, benefits to cover the needs of the so-called education and participation package – with the exception of learning support – will also be applied for. These are needs for participation in school trips, class trips, school transport, lunch in daycare centres and schools, and, for those entitled to benefits up to the age of 18, needs for participation in the social and cultural life of the community. Please use the forms provided to claim these benefits. The decision on benefits to cover the above-mentioned needs in accordance with Section 28 (2), (4), (6) and (7) of SGB II is made separately by the Salzlandkreis Job Centre.
Reporting obligations
From the day you apply for benefits under SGB II, you are obliged to report personally to the Salzlandkreis Job Centre or another Job Centre office and, if necessary, to attend a medical or psychological examination if you are requested to do so by the Salzlandkreis Job Centre. These reporting obligations also apply to you during appeal or social court proceedings. If you are unable to keep an appointment, please inform the Job Centre in advance. Please also state the reason for this.
Accessibility
In principle, you must be in the immediate area of the responsible Job Centre on every working day (this also includes Saturday) and be able to take note of its notifications and requests every working day. Closer area means that you must be able to visit an office of the Salzlandkreis Job Centre, a possible employer or the location of an integration measure in the local area of responsibility of the Salzlandkreis Job Centre within a reasonable period of time for the placement process and without unreasonable effort or effort that exceeds your own ability to pay.
With the prior consent of the Salzlandkreis Job Centre, you can stay outside the immediate area of the Salzlandkreis Job Centre for a maximum of 21 calendar days per calendar year. An extension is generally not possible. Only in cases of exceptional hardship caused by unforeseeable or unavoidable events can the three-week period be extended by up to 3 days. After returning to your place of residence, you must report back to your job centre in person without delay. You always need the Job Centre's approval in advance if you are going to be away from home.
Unauthorised absence will result in the benefits being cancelled and, if necessary, reclaimed. This applies in particular if there is no good reason for the absence and the integration into training or work is significantly impaired as a result.
