Outdoor advertising refers to forms of advertising in which the advertising medium is situated in a public space.
Under the Building
Regulations of the State of Saxony-Anhalt, a planning permission is not required, amongst other things, for advertising structures, provided that they are subject to authorisation under road or road traffic law. It must therefore be assessed whether the advertising structure constitutes a building that may be subject to restrictions under road traffic or roads legislation. Only if these conditions are not met would a planning permission under the Building Regulations be an option. The objectives of the respective legal requirements differ in this respect. Road traffic law is directly concerned with the protection of traffic. The building regulations under road law serve the specific need to protect the road in its function as a traffic route. The provisions of the State Building Regulations govern land use issues and the structural and technical requirements for the structure. It is essential that all these considerations are taken into account.
The road authority is required to make the road available to the public as a traffic route in a fit condition. This also depends on the structural conditions in the area adjacent to the road. Among other things, any (intentional) diversion of the flow of traffic caused by structures, in particular advertising, on neighbouring plots is considered disruptive. It must be assessed whether the intended advertising is to be installed within or outside a town thoroughfare along a district, state or federal road. Within such town thoroughfares, it is important to distinguish between access areas and connecting areas of a town thoroughfare, due to differing legal requirements. Structures located outside the sections of the town thoroughfare along federal, state or district roads designated for the development of adjacent plots (development area), at a distance of up to 40 metres, require the approval of the competent road construction authority specified below.
Last but not least, it may also be worth noting that an advertising structure may fall under the regulations governing special use, for which a special-use permit must be granted.Who should I contact?
As the legal situation is not easy for members of the public to understand, and as a large number of different authorities would otherwise be responsible, the state of Saxony-Anhalt has developed a straightforward procedure. In cases where there are prohibitions or restrictions on the erection of advertising structures under road traffic law, or where a special use permit may be required, all application formalities relating to the installation of an advertising structure can be submitted in writing, without any specific format, to the following road construction authorities:
- for local roads, via the relevant local authority
- for district roads, via the relevant district authority
- for state roads, via the branch of the Saxony-Anhalt State Roads Authority responsible for the area (this also applies to federal roads for which the state acts on behalf of the federal government as part of its contract management responsibilities). The addresses are as follows:
