According to § 24 Para. 3 No. 1 - 3 SGB II, one-off needs (one-off benefits) include
- Initial furnishings for the flat including household appliances;
- Initial outfits for clothing and initial outfits for pregnancy and birth, and
- Purchase and repairs of orthopaedic shoes, repairs of therapeutic devices and equipment as well as the hire of therapeutic devices.
One-off requirements are not included in the standard requirement and are generally granted as a subsidy. Benefits for these needs are paid separately. Benefits are also paid if those entitled to benefits do not require benefits to secure their livelihood, including reasonable costs for accommodation and heating. In these cases, the income that the applicant acquires within a period of up to six months after the end of the month in which the decision on the benefit is made can be taken into account.
In accordance with the BSG judgements of 20 August 2009 (B 14 AS 45/08 R) and 13 April 2011 (B 14 AS 53/10 R), the Salzland district's instructions for the deviating provision of benefits in accordance with Section 24 (3) SGB II and one-off requirements in accordance with Section 31 SGB XII have been updated. The basic income support provider is granted a discretionary right to choose whether to provide the benefits in kind or in cash. If the basic income support provider chooses the "cash benefit" type of benefit, this can be provided in the form of lump sums. The determination of the amount of the lump sums is subject to judicial review. The lump sum must be calculated in such a way that the person in need of assistance can meet their initial equipment requirements with the amount chosen. The lump sum must take into account comprehensible empirical values and appropriate information on the necessary expenses. Benefits in kind can be provided in the form of vouchers.
